  4. Installer 43.3 and Installer project icon (hereinafter "Files") and
  5. their related documentation, utilities, and examples
  6. (c) Copyright 1995-1996 Amiga, Inc.  All Rights Reserved

  8. These Files and their related documentation, utilities, and examples
  9. are provided "AS-IS" and subject to change without notice; no warranties
  10. are made.  All use is at your own risk.  No liability or responsibility
  11. is assumed.

  13. A. DISTRIBUTION OF UNMODIFIED INSTALLER DEVELOPER ARCHIVE
  14.  
  15. The complete and unmodified Installer developer archive, as provided by
  16. Amiga, Inc., may be freely redistributed via any means which
  17. preserves its copyrights. The archive may not be sold for profit.

  20. B. DISTRIBUTION OF INSTALLER
  21.  
  22. Specific Files from the archive may be reproduced and distributed
  23. separately under license subject to agreement with the following terms
  24. and conditions (wherein the reference to Files shall mean Installer and
  25. the Installer project icon, either individually or collectively):
  26.  
  27. 1.   The Files may be reproduced but may not be modified in any way.
  28.  
  29. 2.   The Files may only be distributed as an integral part of a software
  30.      product solely for AMIGA computers.
  31.  
  32. 3.   The related documentation, utilities, and examples provided by
  33.      Amiga, Inc. may not be reproduced or distributed,
  34.      in whole or in part, except as part of a complete and unmodified
  35.      archive as provided by Amiga, Inc.
  36.  
  37. 4.   Licensee shall hold Amiga, Inc. harmless from any
  38.      and all claims, damages and liabilities resulting from or arising
  39.      out of its use or distribution of the Files.
  40.  
  41. 5.   All copies of Licensee's software product containing the Files and
  42.      of Licensee's product documentation related thereto (either paper
  43.      or electronic) must include the following copyright notice:

  47.      Reproduced and distributed under license from Amiga, Inc.

  49. 6.   Licensee's product documentation (either paper or electronic) must also
  50.      include a disclaimer substantially similar to the following:

  52.      INSTALLER SOFTWARE IS PROVIDED "AS-IS" AND SUBJECT TO CHANGE;
  53.      NO WARRANTIES ARE MADE.  ALL USE IS AT YOUR OWN RISK.  NO LIABILITY
  54.      OR RESPONSIBILITY IS ASSUMED.

  56. 7.   Licensee may only distribute the versions of the Files that have
  57.      been approved by Amiga, Inc. for electronic licensing
  58.      as evidenced by Amiga, Inc.'s inclusion of the Files in an
  59.      official Amiga, Inc. archive or diskette containing the Files,
  60.      the related documentation, utilities, and examples, and this Electronic
  61.      License Agreement. Ongoing distributions must include only the most
  62.      recently approved releases of the Files which Amiga, Inc. has
  63.      designated for electronic licensing and distribution.

  65. 8.   The Files may not be installed on a user's system or Workbench
  66.      unless the installation procedure included with Licensee's product has
  67.      determined that the user's system or Workbench does not contain a more
  68.      recent version of the Files.

  70. 9.   Such technical information as is contained in the Files (and any
  71.      product thereof) or in the related documentation, utilities, and
  72.      examples may not be exported in contravention of the laws and
  73.      regulations of the Federal Republic of Germany.

  75. 10.  Prior to any distribution of the Files, Licensee must acknowledge and
  76.      consent to these terms by forwarding a completed and signed copy of
  77.      this entire Agreement, on paper, to:

  80. 11.  Amiga, Inc. may terminate this license at any time,
  81.      with or without cause. This license and Licensee's rights hereunder
  82.      will automatically terminate upon any breach of these terms and
  83.      conditions. Upon any such termination, Licensee shall destroy all
  84.      copies of the Files and the related documentation, utilities, and
  85.      examples in its possession.
